Our privacy policy and how we use your data

This Privacy Policy describes the privacy practices of Knilb Inc. ("Knilb", "we", "us", or "our") and how we handle personal information that we collect through our website, app, and any other services that link to this Privacy Policy (collectively, the "Services").

Our Services are designed for businesses, particularly tech companies and product-engineering teams, and are not intended for personal, family, or household use. Accordingly, we treat all personal information covered by this Privacy Policy as pertaining to individuals acting as business representatives, rather than in their personal capacity.

1. Personal Information We Collect

Information you provide to us:

  • Contact and account information: Including your first and last name, company name, email address, phone number, and username and password for an account on the Services.
  • Payment information: Such as billing address and payment details. Payments are processed by our payment provider, Stripe. We do not have access to your payment card numbers. See Stripe's Privacy Policy for more information.
  • Feedback and correspondence: Information you provide when you contact us with questions, feedback, or otherwise interact with us.
  • Usage information: Details about your interactions with our Services, such as content uploaded or submitted and any other information provided through our Services.
  • Other information: Additional information we may collect as disclosed at the time of collection.

Information we obtain from third parties:

  • Social media information: Information from interactions with our pages on social media platforms.
  • Third-party login information: Information shared with us when logging in via Google or Microsoft, including basic profile data.
  • Other sources: Information from other third parties, such as marketing partners and publicly-available sources.

Automatic data collection:

We, our service providers, and advertising partners may automatically log certain information about you and your device, including:

  • Device data: Information about your computer or mobile device, such as the operating system, device type, unique identifiers, IP address, and general location data.
  • Online activity data: Information about your activity on our Services, such as pages viewed, access times, and interactions with emails or other content.

2. How We Use Your Personal Information

We use your personal information to:

  • Communicate with you about our Services, including updates and support messages.

  • Online tracking opt-out: You can manage cookie settings and opt out of tracking via your browser settings or third-party opt-out tools.
  • Do Not Track: Our Services do not currently respond to Do Not Track signals.

5. Data Retention

We retain personal information for as long as necessary to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. Specifically:

  • Account information: Retained for the duration of your account and for up to 60 months after account closure, unless a longer period is required by law or for legitimate business purposes such as tax, accounting, or fraud prevention.
  • Customer content and test data: Retained for the duration of your account. Upon account closure, this data is deleted within 30 days, except where retention is required by law.
  • Usage and analytics data: Retained in identifiable form for up to 24 months, after which it is aggregated or anonymized.
  • Marketing communications data: Retained until you opt out, after which we retain only the minimum information needed to honor your opt-out.

When personal information is no longer needed, we delete or anonymize it using commercially reasonable methods.

6. Security Practices

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, or destruction. These include encryption of data in transit, access controls, logging, and regular review of our security practices.

In the event of a security incident affecting your personal information, we will notify you and applicable regulators as required by law. No security measure is foolproof, and we cannot guarantee absolute security.

7. Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA"), provides you with specific rights regarding your personal information.

Categories of personal information we collect: In the preceding 12 months, we have collected the following categories of personal information, as defined by the CCPA: identifiers (such as name, email address, and IP address); commercial information (such as billing details); internet or other electronic network activity information (such as usage data); professional or employment-related information (such as company name and role); and inferences drawn from the above to create a profile reflecting preferences and characteristics.

Sources of personal information: We collect personal information directly from you, from your interactions with our Services, from third-party login providers, and from marketing partners and publicly-available sources.

Business purposes for collection: We collect personal information for the purposes described in Section 2 of this Privacy Policy.

Categories of third parties with whom we share personal information: We share personal information with the categories of recipients described in Section 3 of this Privacy Policy.

Sale or sharing of personal information: We do not sell personal information for monetary consideration. However, our use of advertising cookies and similar technologies for interest-based advertising may qualify as "sharing" under the CCPA. You have the right to opt out of this sharing.

Your rights: Subject to certain exceptions, you have the right to: - Know what personal information we collect, use, disclose, and share about you. - Request a copy of the personal information we have collected about you in the preceding 12 months. - Request that we correct inaccurate personal information. - Request that we delete personal information we have collected from you. - Opt out of the sharing of personal information for cross-context behavioral advertising. - Limit the use and disclosure of sensitive personal information (we do not currently collect sensitive personal information as defined by the CCPA). - Not be discriminated against for exercising any of these rights.

How to exercise your rights: You may exercise your rights by emailing us at legal@knilb.com or by using the "Do Not Sell or Share My Personal Information" link on our Website. We will verify your identity before responding to your request. You may also designate an authorized agent to make a request on your behalf, subject to verification.

We honor Global Privacy Control ("GPC") signals as a valid request to opt out of sharing for users who visit our Website with GPC enabled.

8. Your European Privacy Rights

If you are located in the European Economic Area, the United Kingdom, or Switzerland, the General Data Protection Regulation ("GDPR") and equivalent laws provide you with specific rights regarding your personal information.

Data controller: Knilb Inc. is the data controller for personal information collected through the Services, except where we process customer content on behalf of our business customers, in which case we act as a data processor.

Legal bases for processing: We process personal information on the following legal bases: - Performance of a contract: To provide the Services you have requested. - Legitimate interests: To operate, secure, and improve our Services, and to communicate with you about them. - Consent: For marketing communications and non-essential cookies, where required. - Legal obligation: To comply with applicable laws.

Your rights: Subject to certain exceptions, you have the right to access, correct, delete, restrict, or object to the processing of your personal information; the right to data portability; and the right to withdraw consent at any time where processing is based on consent. You also have the right to lodge a complaint with your local data protection authority.

International transfers: When we transfer personal information from the European Economic Area, the United Kingdom, or Switzerland to the United States, we rely on Standard Contractual Clauses or other approved transfer mechanisms.

9. Children

Our Services are not intended for use by children under 13 years of age, and we do not knowingly collect personal information from children under 13.

10. International Users

By using our Services, you agree to the transfer of your personal information to the United States and other jurisdictions where we operate.

We may update this Privacy Policy periodically. Changes will be effective upon posting on our Services, with the updated date. We may also notify you through other means if required.
